These Terms of Service ("Terms") constitute a legally binding agreement between you ("Member," "you," or "your") and The Appraiser Accelerator, a division of JSquaredTeam.com ("Company," "we," "us," or "our"). By subscribing to our services or using our website at www.theappraiseraccelerator.com, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services. We reserve the right to update these Terms at any time, and your continued use of our services constitutes acceptance of any changes.
The Appraiser Accelerator provides done-for-you marketing services designed exclusively for real estate appraisers. Our services may include, but are not limited to:

A core feature of our service is county exclusivity. We accept only one member per county to ensure our members do not compete with each other using our marketing system. By subscribing, you are securing exclusive rights to our marketing services within your designated county or counties.
County exclusivity is maintained for the duration of your active subscription. If your subscription is canceled or terminated for any reason, exclusivity for your county may be offered to another appraiser.
We reserve the right to determine county boundaries and resolve any disputes regarding county assignments at our sole discretion.

Prices are subject to change. Any price changes will be communicated to existing members in advance and will take effect at the start of your next billing cycle.
All payments are processed securely through Stripe. By providing your payment information, you authorize us to charge your selected payment method for the applicable subscription fees.
We stand behind our services with a 90-day performance guarantee. If, within the first 90 days of your active subscription, you have not received measurable results from our marketing efforts, you may request a full refund of the fees paid during that period, subject to the following conditions:

Monthly plans require a 12-month minimum commitment. You may cancel your monthly subscription after the initial 12-month period by providing at least 30 days written notice before your next billing date. If you cancel before the 12-month commitment is fulfilled, you may be charged an early termination fee equal to the remaining months in your commitment period.
Annual plans may be canceled by providing at least 30 days written notice before your renewal date. If you cancel before the end of your annual term, no refund will be issued for the remaining portion of the year, except as covered by our 90-day guarantee.

All marketing materials, website designs, content, strategies, tools, and systems created by us remain the intellectual property of The Appraiser Accelerator unless otherwise agreed in writing. You are granted a non-exclusive, non-transferable license to use these materials for the duration of your active subscription.
Upon cancellation or termination, your license to use our proprietary materials ends. Custom content created specifically for your business (such as website copy and blog posts) may be transferred to you upon request, subject to any third-party licensing restrictions.
To the maximum extent permitted by law, The Appraiser Accelerator and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of revenue, loss of profits, or loss of business opportunities.
Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the total amount you have paid to us in the 12 months preceding the claim.
Our services are provided "as is" and "as available." While we strive to deliver excellent results, we do not guarantee specific outcomes such as a particular number of leads, revenue increases, or search engine rankings. Marketing results vary based on many factors including market conditions, competition, and local demand.
The 90-day guarantee (Section 6) is our commitment to demonstrating measurable progress, not a guarantee of specific financial results.
You agree to indemnify, defend, and hold harmless The Appraiser Accelerator, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services, your violation of these Terms, or your violation of any applicable law or regulation.
Any disputes arising from these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state where The Appraiser Accelerator maintains its principal place of business.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against us.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Appraiser Accelerator regarding your use of our services. Any prior agreements, representations, or understandings are superseded by these Terms.
